Success! Full Planning Granted for new Stables, Horse Walker and Manege in the Surrey Hills
The applicants site is in designated Green Belt, the Surrey Hills Area of Outstanding Natural Beauty (AONB) as well as an Area of Great Landscape Value (AGLV), an earlier permission granted a similar, yet outlandish scheme in the private 6-hectare garden of the residence but following landscaping it was decided by the applicant not to build the equestrian facilities in that location.
A pre-application was submitted to Waverley Borough Council in 2019 presenting three viable options for a similar scheme but with less outlandish stabling facilities to be placed closer to agricultural grazing land and other land, which Prism Ag had already secured the benefit of a Change of Use of Land to Equestrian Use for the applicants private equestrian uses in 2018 and 2019, respectively.
A positive pre-app response from the LPA dictated their preferred location and the new full planning application was prepared and submitted. The application was subject to various conditions, negotiated by Prism Ag to better reflect the applicants requirements and a Planning Solicitor was drafted in to work with the LPA’s solicitor on drafting a Section 106 agreement, the signing of the document effectively cancels the former approval and grants the latter approval.
The applicant cannot therefore retain both permissions, even if the site were to be sold. The new permission effectively separates the equestrian uses from the residential uses at the site and groups the equestrian uses together with the equestrian land and leaves the residential gardens connected with the large house.
